In observance of Legislative Decree 30 June 2003 no. 196 (Privacy Consolidated Act), we hereby provide you with the information concerning the purposes and modalities of the processing of your personal data, as well as the communication and dissemination of the same, the nature of the data in our possession and their conferment.
FERRARI F.LLI LUNELLI S.P.A. processes users' personal information very carefully. This privacy policy sets out the privacy policy of FERRARI F.LLI LUNELLI S.P.A. that governs the areas protected by passwords of those sites under FERRARI F.LLI LUNELLI S.P.A. and all the related company sites of those companies contractually linked to FERRARI F.LLI LUNELLI S.P.A. or members of the Group, websites (collectively known as the "websites" and separately as the ''website'') through which FERRARI F.LLI LUNELLI S.P.A. collects personal data. By accessing or making use of the websites above, the user furthermore expressly accepts the terms and conditions set out in this privacy policy. In the event of disagreement with any term or condition in this privacy policy, you are kindly asked not to use this website and not to provide your personal data. Some services may be conditional upon the provision of personal data.

1 Personal data
For those purposes provided for under this privacy policy, "Personal Data" means all the information through which the user can be personally identified, and include, as an example but by no means limited to, name, surname, address, telephone number or mobile phone number), email address, age, date of birth, sex, profession, data and details regarding products, satisfaction with regard to products, language, etc.
2 FERRARI F.LLI LUNELLI S.P.A.'s Privacy Policy governs the elaboration of the user's personal data, including, as an example but by no means limited to, the collection, use, conservation and protection of the information provided by and/or collected from the user for the purposes indicated below.

Purposes of the processing for which consent is granted where requested (Section 23 of Legislative Decree 196/03)
a)
management of the processing of data concerning:
- activities strictly connected and instrumental to the management of the relationship (e.g. the acquisition of preliminary information at the conclusion of an agreement, execution of operations based on the obligations deriving from concluded contracts, etc);
- supply of goods and services and for the protection of the credit positions deriving from said goods and services;
- registration to the mailing list;
- to proceed to the provision of the related services as provided in the related contractual terms and conditions and therefore to allow the carrying out of all the activities regarding the execution of the contractual agreement and to perform all the relative services and fulfil all the relative obligations, as well as for statistical investigations in anonymous form;
- accounting activities (issuing of invoices, preparation of payments) and any transfers of data abroad also to non-EU countries within the limits of the law (indicated below in the section "regarding communication and dissemination");
- sending of products and services by FERRARI F.LLI LUNELLI S.P.A.;
- controlling access to those areas protected by passwords;
- improvement and protection of the websites;
- processing of the requests for information;
- internal evaluation of products and services of FERRARI F.LLI LUNELLI S.P.A.;

b) for the communication of data by FERRARI F.LLI LUNELLI S.P.A to companies of the Lunelli Group (Surgiva F.lli Lunelli S.p.A., Segnana F.lli Lunelli S.p.A., Locanda Margon S.r.l., Società Agricola Lunelli SS, Tenuta Podernovo Società Agricola S.r.l., Tenuta Castelbuono Società Agricola S.r.l.), which are appointed persons in charge of processing, for the purpose of sending commercial information linked to the above listed companies. For such exclusive purposes your data may be communicated by FERRARI F.LLI LUNELLI S.P.A. to firms allied to and/or controlled by FERRARI F.LLI LUNELLI S.P.A., to companies contractually connected to FERRARI F.LLI LUNELLI S.P.A. or members of its distribution network, also those which may have offices in non-EU countries, and in this case the data will be processed by said companies exclusively for:
- promotional communications (including personalised communications) for information activities related to its own products;
- to receive communications via e-mail, newsletter and advertising circulars concerning its own products;
- organisation of meetings, conventions and the like;
The personal data of the user will not be used for purposes mentioned in point b) without having first received the consent of the same. At the moment of provision of personal information the user is entitled to opt for such service.

Processing and preservation modalities
Processing will be carried out in automated form and/or manually, with modalities and instruments aimed at guaranteeing the highest level of security and confidentiality, by specifically appointed individuals in compliance with that provided by Sections 31 ff. of Legislative Decree 196/03. The data will be kept at our offices in Trento or at the offices of parent company or third parties identified each time to carry out the services to be provided for the time strictly necessary for the purposes mentioned above and, in any case, not longer than the period prescribed by law. In compliance with the law in force, specific security measures are observed in order to prevent the loss of data, unlawful or incorrect use of data and unauthorised access. Persons under the age of 18 may provide their personal data only with the consent of their legal representative (a parent or guardian, for example). The user holds harmless FERRARI F.LLI LUNELLI S.P.A. and its affiliates for any injury, loss or damage, whether to persons or property deriving from the acceptance of, or participation to, the websites.

Personal data for contractual, administrative/accounting purposes will be kept for a period no longer than the administrative purposes for which the data were collected and subsequently processed, while for commercial communications for a period of no longer than the purposes of mere communication, while no use for the purposes of marketing and direct profiling will made of the data.

Regarding communication and dissemination
The data, subject of the processing, will not be disseminated, but may be communicated by FERRARI F.LLI LUNELLI S.P.A., for the purposes listed above, to firms allied to and/or controlled by FERRARI F.LLI LUNELLI S.P.A., also the parent company of the Group, and listed above, to companies contractually connected to FERRARI F.LLI LUNELLI S.P.A. or members of its distribution network, also those which may have offices in non-EU countries, and in this case the data will be processed exclusively for the aforementioned purposes. Data may be communicated abroad to countries within the EU, in compliance and within the limits of Section 42 of Legislative Decree no. 196/2003. Personal data may be transferred abroad to non-EU countries with regard to and within the limits provided by Section 44 letter b) of Legislative Decree no. 196/2003. Data can be communicated to third parties belonging to the following categories:
- subjects who provide services for the management of the information system used by FERRARI F.LLI LUNELLI S.P.A. and the telecommunication networks (including electronic mail);
- subjects, including external subjects, for the management of the archiving of paper and/or computerised documentation;
- service companies for the acquisition, recording and processing of the data originating from documents, or supplied media and originating from the same clients and concerning massive operations regarding payments, effects, cheques and other instruments;
- subjects who perform customer assistance activities, also via internet websites (e.g. call centres, help desks etc);
- offices or companies regarding assistance and consultancy, also to control business organisational management;
- to companies contractually connected to FERRARI F.LLI LUNELLI S.P.A.;
- subjects belonging to the distribution network of FERRARI F.LLI LUNELLI S.P.A.;
- bodies and Public Administrations for assessments and checks in observance of fiscal and civil obligations;
- banking, credit and insurance institutions for the execution of economic activities (payments/receipts) and insurance activities;
- subjects who perform the control, auditing and certification of the activities implemented by FERRARI F.LLI LUNELLI S.P.A. also in the interest of clients
- for the purposes mentioned in point b) personal data may be communicated to business surveying and marketing companies.

Subjects belonging to the aforementioned categories perform the function of Data Processor, even though they operate entirely autonomously as separate Data Controllers. The list of Data Processors is constantly updated and available at the offices of FERRARI F.LLI LUNELLI S.P.A. Any further communication or dissemination will take place only subject to your express consent. FERRARI F.LLI LUNELLI S.P.A,does not sell, rent or distribute in any other way the user's personal data to third parties, except in the case in which it is necessary to do so in order to provide the services for which the information was provided. Data processing on behalf of FERRARI F.LLI LUNELLI S.P.A. may be carried out by any person appointed by the same company, or by third parties, with whom FERRARI F.LLI LUNELLI S.P.A. ha stipulato has entered into contracts with so as to guarantee the observance of the legislation in force with regard to personal data protection.
The websites contain links to websites controlled by and pages maintained by third parties who are external to the company. FERRARI F.LLI LUNELLI S.P.A. does not check the use of the information provided to said third parties and the information supplied will be subject to their privacy policy. FERRARI F.LLI LUNELLI S.P.A. applies the technology normally used to safeguard the unlawful use of the personal data. Only authorised persons have access to the user's personal data. Should FERRARI F.LLI LUNELLI S.P.A. entrust its partners with the total or partial execution of its web surveys, FERRARI F.LLI LUNELLI S.P.A. will enter into contracts with the same partners which will oblige them to process the user's personal data with the same level of absolute confidentiality. The preservation and sending of personal data via the internet is protected by up-to-date technological means normally in use.

 

Nature of conferment
The conferment of data for the purposes mentioned in point a) is optional, and therefore does not derive from a normative obligation, but it is necessary in order to conclude and execute the relative contract. Any refusal to give consent to processing for the purposes listed above in point a) will entail the impossibility to register on the website of FERRARI F.LLI LUNELLI S.P.A.  and all the related company websites of companies contractually connected to FERRARI F.LLI LUNELLI S.P.A.. or members of its distribution network, websites (collectively known as "websites" and separately as the ''website'') through which FERRARI F.LLI LUNELLI S.P.A. collects personal data. Any refusal to give consent with regard to point a) will entail the impossibility to carry out activities strictly connected and instrumental to the management of relations with FERRARI F.LLI LUNELLI S.P.A., which may also entail the impossibility to provide the services themselves, necessary in order to perform the contractual obligations.
Furthermore, the Data Controller makes it known that any non-communication, or erroneous communication, of any of the obligatory information, will have as emergent consequences:
- the impossibility for the Controller to guarantee the compliance of the processing itself with the contractual agreements for which processing is being performed;
- the possible non-correspondence of the results of the processing itself to the obligations imposed by fiscal, administrative and civil law to which it is directed.
In the event that the registration form is not provided with the data indicated as "obligatory" it will not therefore be possible to complete the registration procedure.
The conferment of data for the purposes mentioned in point b) is optional, and therefore does not derive from a normative obligation: the non-conferment of data for such purposes will have as its sole consequence the impossibility of being contacted by FERRARI F.LLI LUNELLI S.P.A. and by companies connected to and/or controlled by FERRARI F.LLI LUNELLI S.P.A., also the parent company of the Group, for promotional communication, also personalised communications, information activities and investigations concerning customer satisfaction.
Any refusal to give consent for the purposes illustrated and mentioned in point b) ) above, will not entail any negative consequence with regard to your requests and the execution of the relative contract.
You may exercise your rights as expressed in Sections 7, 8, 9 and 10 of Legislative Decree 30 June 2003 no. 196 by contacting the person in charge of processing: Mr Guido Pianaroli c/o Ferrari F.lli Lunelli S.p.A., Via Ponte di Ravina, 15, 38123 Trento, Italy.

Cookies
Cookies are files or parts of information which are stored on the hard drive of the user's computer (files sent from the website server to the user's browser) when the user visits the website. The session cookies used have the aim of speeding up the analysis of the Internet traffic and facilitate users' access to the services offered by the website. The majority of browsers are set to accept cookies. If you do not wish to accept cookies it is possible to set the computer so that it refuses them or displays a message when they are stored. If the user refuses the use of cookies, the possibility of providing personalised services will be limited. In this latter case some of the functions of the website might not functions correctly and some of the service might not be available. Cookies cannot be used and will not be used to capture the email address of visitors, to obtain information from the hard drive or to acquire confidential or sensitive information regarding visitors. In order to allow the activation of specific functions of the services, and for the time in which these services will be provided, the website will use so-called cookies. Data concerning cookies will not be disseminated.

In the event of participating in surveys, users are asked to indicated if they can be contacted at a later date for further research purposes such as, for example, the opinion of the user regarding new products, on the characteristics and so on. In the event of a positive reply to such opinion, included in the majority of questionnaires, users may be contacted subsequently by email or telephone, until the person concerned objects.
FERRARI F.LLI LUNELLI S.P.A. reserves the right to change, modify, add or remove parts of this privacy policy, at its own discretion and at any moment. The user is obliged to periodically check for any modifications to this page. By continuing to use the website after the publication of the modifications to this privacy policy will be construed as an acceptance of these same modifications.

Section 7. Right to access personal data and other rights
1. The data subject shall have the right to obtain confirmation as to whether or not personal data concerning him exist, regardless of their being already recorded, and communication of such data in intelligible form. 2. The data subject shall have the right to be informed: a) of the source of the personal data; b) of the purposes and methods of the processing; c) of the logic applied to the processing, if the latter is carried out with the help of electronic means; d) of the identification data concerning data controller, data processors and the representative designated as per Section 5(2); e) of the entities or categories of entity to whom or which the personal data may be communicated and who or which may get to know said data in their capacity as designated representative(s) in the State's territory, data processors(s) or person(s) in charge of the processing. 3. The data subject shall have the right to obtain: a) updating, rectification or, where interested therein, integration of the data; b) erasure, anonymization or blocking of data that have been processed unlawfully, including data whose retention is unnecessary for the purposes for which they have been collected or subsequently processed; c) certification to the effect that the operations as per letters a) and b) have been notified, as also related to their contents, to the entities to whom or which the data were communicated or disseminated, unless this requirement proves impossible or involves a manifestly disproportionate effort compared with the right that is to be protected. 4. The data subject shall have the right to object, in whole or in part: a) on legitimate grounds, to the processing of personal data concerning him/her, even though they are relevant to the purpose of the collection; b) to the processing of personal data concerning him/her, where it is carried out for the purpose of sending advertising materials or direct selling or else for the performance of market or commercial communication surveys.

For any request for information and/or clarification, questions or claims concerning the processing of personal data we ask you to write directly to the person in charge of processing, as indicated below:

In the event that the user does not wish to be contacted any more, the use of personal data will cease immediately. In the event the user contacts the company, the user is kindly asked to provide an email address, name, address and/or telephone numbers, in order to allow the correct management of the request. To be cancelled from the mailing list at any moment the user is asked to write an email to privacy@cantineferrari.it or by post to FERRARI F.LLI LUNELLI S.P.A. - Via Ponte di Ravina, 15 – 38123 Trento with the subject line “cancellation from mailing list”. The updated list of persons in charge will be communicated upon a simple request being made, to be sent by e-mail to privacy@cantineferrari.it or by post to FERRARI F.LLI LUNELLI S.p.A.
